11. SMS/Text Message Terms
As part of the Hemut platform’s alert and notification functionality, Hemut may send SMS/text messages to Authorized Users (people given access to the platform by a business customer of Hemut, their “Customer Organization”) on behalf of their Customer Organization. These SMS terms apply to those messages.
- Consent: Authorized Users consent to receive SMS messages by entering a mobile number, selecting the alert categories they want, and checking the consent box on the platform’s Settings → Alerts page. Drivers may also receive messages at a work mobile number provided by their Customer Organization for operational communication. By providing your mobile phone number and enabling SMS alerts, you expressly consent to receive automated text messages from Hemut related to platform operations. Consent to receive text messages is not a condition of purchasing any goods or services or of using the platform.
- Types of Messages: SMS messages may include operational alerts, load updates, ETA and delay notifications, safety notifications, delivery status updates, account messages such as an invitation or sign-in link for the Hemut Driver App, and other time-sensitive information relevant to the Authorized User’s role. Messages are transactional and operational in nature. Phone numbers are never used for marketing purposes — only for platform alerts, notifications, and account messages.
- Message Frequency: Message frequency varies based on alert activity and the Authorized User’s role and notification preferences.
- Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message, or by disabling SMS alerts in your platform settings. Opting out of SMS does not affect other platform functionality.
- Opt-In: If you have previously opted out, you may opt back in by replying START or by re-enabling SMS alerts in your platform settings.
- Help: For help with SMS alerts, reply HELP to any message or contact privacy@hemut.com.
- Rates: Message and data rates may apply depending on your mobile carrier and plan. Hemut is not responsible for any charges imposed by your carrier.
- Carrier Liability: Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier.
- Supported Carriers: Hemut supports messaging on all major U.S. mobile carriers. However, service availability may vary by carrier and location.
- No Warranty on Delivery: While Hemut makes reasonable efforts to deliver SMS messages in a timely manner, we do not guarantee delivery of any particular message.
- Privacy: Our handling of mobile numbers and SMS consent is described in our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Website after such changes constitutes your acceptance of the updated Terms.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Delaware.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
15. Entire Agreement
These Terms constitute the entire agreement between you and Hemut Co regarding your use of the Website and supersede any prior agreements or understandings
